| Abstract | Today, Ukraine is undergoing the historical stage of becoming an independent and sovereign state in an armed confrontation not only with an external aggressor, protecting territorial integrity, but also in combating legal uncertainty and corruption within the country. One of these steps is the implementation of large-scale reforms aimed at consolidating democracy and building a rule of law. One of the main problems of civil development is the strengthening of the rule of law and law. In this regard, the priority is to ensure the rule of law. A modern, socially oriented, legal state is impossible without an effective judicial protection of the interests of society and the state. The court itself is the institution that makes the final decision in legal disputes within the national legal system. At the same time, the functions of representing the interests of the state in court are an integral part of the judicial protection mechanism, by the bodies of the prosecutor’s office of Ukraine, in cases determined by law. Land defense is a special purpose land with a special legal status and a mode of use and disposal by them, which is determined by the possibility of their being in state ownership. Therefore, the purpose of the article is to investigate the representation of the military prosecutor’s office in relation to the observance of legislation in the use of land defense. For its achievement, the representative activity of the military prosecutor’s office in court was investigated, due to the need to ensure the proper protection of state interests, the need to adhere to the rule of law. Such powers of the prosecutor’s office are in line with the standards laid down in the documents of the Council of Europe and the European Union. As a result, the conclusion was drawn about the importance of representing the interests of the state in court, as well as the practice (decision) of the European Court of Human Rights on this issue. |
